Eminant Domain

On Fox last night, I saw a story about some city trying to kick a WWII veteran out of his house so they can turn the land over to a contractor to build condos. The guy is terminal with cancer and has about two years to live.

While what the city is doing is perfectly legal (thanks to the wisdom of the Supreme Court) it is completely immoral. It also indicates the wide spread impacts that this Supreme Court ruling is having. Cities now see $$$ in taking peoples land. An easy fix to tight municipal budgets. Under the current law this man really has no rights to his land. The only barganing chip he has is his status and the really bad publicity the city is going to get. Hopefully this case will serve to bring the impacts of this stupidity to the publics attention. Hopefully the SC will be able to revisit this ruling with Alito & Roberts on the bench.

Here is my proposed Florida Constitutional Amendment.


Right to own and keep Property.--The right of persons to own property shall not be denied or abridged on account of membership or non-membership in any organization.

Property that is taken under Eminent Domain must remain under public ownership and if it is accessible, must be assessable by everyone. If the property is to be returned to private use or ownership, the previous owner must be given the first opportunity to repurchase the property for the same price they were paid regardless of the current market value.
